These Terms of Use are between you and AccuData Integrated Marketing, Inc. a Washington corporation ("we," "us," and "our"). Your use of the AccuValid.com website or any affiliated websites (the "Website") constitutes an acknowledgement that you have read the most recent version of the Terms of Use and that you agree to adhere to its terms. If you do not agree to be bound by these Terms of Use, please cease all further use. AccuData reserves the right to amend these Terms of Use at any time.

We use the services of a marketing company to help us measure the effectiveness of our advertising and how visitors use our Website. To do this, we use web beacons and cookies provided by our marketing company on this Website. By supplementing our records, this information helps us learn things like what pages are most attractive to our visitors, which of our products most interest our customers, and what kind of offers our customers like to see.

If you have accessed such products or services prior to entering into a separate product or service agreement, such access is in violation of the Terms of this Website, and you shall immediately cease using such services or delete any such products from your computer or server until such time as you become an authorized user of such products or services.

 

AccuValid Outage Policy 

YOU ACKNOWLEDGE AND UNDERSTAND THAT EXCEPT AS OTHERWISE PROVIDED IN THIS AGREEMENT, ACCUDATA DOES NOT WARRANT THAT THE SERVICES PROVIDED WITHIN THE ACCUVALID PLATFORM WILL BE UNITERRUPTED OR ERROR FREE AND THAT THE ACCUVALID PLATFORM MAY EXPERIENCE HARD OUTAGES OR DELAYS DUE TO INTERNET DISRUPTIONS THAT ARE NOT WITHIN ACCUDATA’S CONTROL.  ANY SUCH HARD OUTAGE SHALL NOT BE CONSIDERED A BREACH OF THIS AGREEMENT BY ACCUDATA.

 

Disclaimer of Warranty; No Consequential Damages; Limitation of Liability

Disclaimer of Warranty. You acknowledge that your use of the Website is entirely at your own risk. Neither AccuData nor any affiliates involved in creating, producing, or delivering the Website is liable for any direct, incidental, consequential, indirect, or punitive damages arising out of your access to, or use of, the Website. Without limiting the foregoing, everything on the Website is provided to you “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESSED OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NONINFRINGEMENT. AccuData also assumes no responsibility, and shall not be liable for, any damages to, or viruses that may infect your computer equipment or other property on account of your access to, use of, or browsing of the Website or your downloading of any materials, data, text, images, video, or audio from the Website.
